Terms of Service

These Terms of Service (the "Terms") govern access to and use of Pickin, the video clipping service available at pickin.io and presented in-product as "clip." (the "Service"), operated by Pickin ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

clip. is an artificial-intelligence workspace that turns long-form video into short-form vertical clips. You provide a source video, either by submitting a public video URL or by uploading a video file. The Service then transcribes the audio, identifies candidate highlight moments, reframes the video to a vertical format, adds captions, and optionally applies your own logo and background music.

You may preview and edit the resulting clips, download them, or publish them directly to a third-party platform account that you have connected, such as TikTok.

2. Eligibility and accounts

  • You must be at least 18 years old and legally able to enter into a contract to use the Service.
  • You must provide accurate account information and keep your login credentials confidential.
  • You are responsible for all activity that occurs under your account.
  • Accounts are personal. Do not share an account with people who are not authorised by you.

3. Credits and usage limits

Processing is metered in minutes of source video, referred to as credits. New accounts receive an initial allocation of credits. Credits are consumed when a processing run completes successfully, based on the measured duration of the source video. A run that produces no clips does not consume credits.

We apply operational limits to keep the Service available for everyone, including a maximum number of concurrent processing runs per account and a maximum upload file size. These limits may change over time.

4. Your content

You retain all ownership of the videos, audio, images, logos, music and other material that you submit to the Service, together with the clips generated from that material (together, "Your Content").

You represent and warrant that you own Your Content or hold all rights and permissions necessary to use it with the Service, including any rights in music, footage, trademarks and the likeness or voice of any person appearing in it, and that processing it through the Service does not infringe the rights of any third party or violate any law or platform rule.

You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, transcode, transcribe, analyse, reproduce and transmit Your Content strictly for the purpose of operating the Service for you, including publishing to a platform account at your explicit request. This licence exists solely to allow us to run the Service and ends when the relevant content is deleted, save for backups retained for a limited period. We do not use Your Content to train our own models and we do not sell it.

5. Acceptable use

You agree not to use the Service to process, generate or distribute:

  • content that you do not have the right to use, including copyrighted video, music or footage used without permission;
  • content that is unlawful, defamatory, fraudulent, deceptive, harassing, hateful, or that incites violence;
  • sexual content involving minors, or any content that sexualises a minor, in any form;
  • content that impersonates a person or organisation, or that misrepresents the origin of the material;
  • synthetic or manipulated media presented as authentic in a way that is misleading or harmful;
  • malware, or content designed to interfere with the operation of any system.

You also agree not to:

  • attempt to gain unauthorised access to the Service, other accounts, or the underlying infrastructure;
  • circumvent usage limits, credits, authentication, or any technical restriction;
  • use automated means to access the Service outside any interface we provide for that purpose;
  • resell or redistribute the Service, or use it to build a competing service;
  • use the Service to violate the terms, policies or community guidelines of any third-party platform.

6. Third-party platforms and publishing

The Service can connect to third-party platform accounts that you own, such as TikTok. Connecting an account is optional and always initiated by you. When you connect an account, you authorise us to act on your behalf only for the specific actions you request, such as reading your basic profile information to display which account is connected, and uploading or posting a clip that you have explicitly chosen to publish.

  • We never post content without an explicit action from you for that specific clip.
  • You remain responsible for complying with the terms of service, community guidelines and advertising rules of each platform.
  • You can disconnect a platform account at any time from your account settings, which revokes our access.
  • Platform features, limits and availability are controlled by the platform and may change or become unavailable without notice.

Where our application is operating in a platform review or sandbox mode, additional platform restrictions may apply, such as limits on the number of connected accounts or a requirement that published posts remain private. The Service surfaces those restrictions when they apply.

7. Automated processing and accuracy

The Service relies on automated speech recognition, large language models and computer-vision techniques. These systems are probabilistic and can produce errors: transcripts may contain inaccuracies, highlight selection is a machine estimate rather than an editorial judgement, captions may mis-transcribe words, and automatic framing may not always track the intended subject.

You are responsible for reviewing every clip before you publish or distribute it. We provide the output on an as-is basis and make no guarantee as to accuracy, suitability, or the performance of any clip on any platform.

8. Our intellectual property

The Service, including its software, interface, design, and underlying processing pipeline, is owned by us and protected by intellectual property law. These Terms grant you a limited, non-transferable, revocable right to use the Service, and no other rights. You may not copy, modify, reverse engineer or create derivative works of the Service, except to the extent that such restriction is prohibited by applicable law.

9. Availability and changes

We aim to keep the Service available but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features at any time, including during maintenance. Parts of the Service may be offered on an evaluation or early-access basis and may change significantly.

10. Suspension and termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate access, with or without notice, if you breach these Terms, if we are required to do so by law or by a third-party platform, or if your use poses a risk to the Service or to other users. On termination, your right to use the Service ends and we may delete Your Content in line with our Privacy Policy.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements or that any defect will be corrected. Nothing in these Terms excludes any statutory rights that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the Service shall not exceed the greater of the amount you paid to us for the Service in the twelve months preceding the event giving rise to the claim, or one hundred euros (EUR 100).

13. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss or expense, including reasonable legal fees, brought by a third party and arising from Your Content, from your use of the Service, or from your breach of these Terms or of the rules of any third-party platform.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide a more prominent notice. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by French law, without regard to conflict-of-law rules. The competent courts of France shall have exclusive jurisdiction over any dispute, subject to any mandatory protection available to consumers under the law of their country of residence.
